A transgender TSA officer at Washington Dulles International Airport is suing the Department of Homeland Security and DHS Secretary Kristi Noem after she was banned from performing pat-down searches on female passengers.
Danielle Mittereder started work at the TSA in June 2024, around three years after the TSA first started to allow transgender TSA officers to perform pat-down searches on passengers of the same gender as they identify as.
But just months after Danielle joined the TSA, President Trump signed Executive Order 14168, Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.
To comply with Executive Order 14168, the TSA announced that it would only allow security officers to conduct pat-down searches based on their sex at birth rather than their gender identity.
Danielle says not long after joining the TSA, she was identified as an “exemplary employee,” but her chances of career progression within the agency have now been severely hampered as promotional roles would require her to conduct pat-down searches – something she is now banned from doing.
TSA officers rotate through several working positions during their shift. They generally change position every 30 minutes, and some of these positions require TSA officers to conduct pat-down searches.
But Danielle, and other transgender TSA officers, have been placed on a form of limited duty because they can’t rotate into positions that would require them to conduct pat-down searches, the lawsuit, first reported by View From the Wing, alleges.
As a result, she says her ability to earn overtime or swap shifts with colleagues has been made much harder.
In addition, Danielle is also barred from using TSA employee restrooms, as these are now reserved for employees based on their sex at birth rather than their gender identity.
Danielle has filed her lawsuit in a Virginia district court, alleging discrimination based on sex and gender identity in violation of Title VII of the Civil Rights Act because she is banned from performing key functions of her job based solely on her being transgender.

Ditto for this. Assuming he had a sex at birth, he can still use TSA employee restrooms.
Why any company would hire a transgender person is beyond me. If you can’t even tell the truth about what sex you are then how can a company expect anything else but situations like this. People tolerate it but it makes everyone uncomfortable. It’s like the Emperor’s New Clothes. Everybody sees and notices the strangeness, but has to act like it’s not odd.
“Danielle” is a Man and should not be touching Women or going into Women’s toilets.
It does not matter what Surgery you have had, or what hormones you take, it is biologically impossible to change sex.
Trans is a very misleading word. It makes people think that you can transition to another sex and you simply cannot. You can identify as another sex if you wish although this is still absurd.
Suing for something that is really of your own causing beggars belief.
